A videotape that was made of Anna Nicole Smith’s 1994 breast augmentation has been issued with a temporary restraining order by a Los Angeles judge.
Smith’s former lawyer and executor of her will - Howard Stern requested the injunction which will prevent the sale, distribution and dissemination of the videotape
Stern accused Smith’s doctor - Gerald Wayne Johnson - who performed the surgery - of sending the tape to a Los Angeles memorial dealer.
Stern also claims that Johnson filmed the procedure without the former model’s consent.
Johnson hit back by saying he routinely records surgeries with permission from the patient, and promises to keep the video confidential "during the patient's lifetime".
Johnson said he gave Riccio permission to use the video after Smith died in Feburary earlier this year.
