If you enter with AP, you become a parolee (based on the fact that you get an I-94 with parolee status on it). Then you resume your work with the H-1B employer. After few months, for some reason your I-485 gets denied. Do you become out of status since your status was parolee?

No, you can continue working in H-1B status, assuming this has not also been denied.

I checked with my immigration attorney about this situation anticipating job change few days ago. According to him one can enter as long as s/he can show new H1B approval notice provided the old H1B visa is still valid (not expired).

As always, we can express our own interpretation, and its always a good idea to contact an immigration attorney to get specific answers.

You are in a pretty tight spot my friend. I think a lawyer is the best person to answer these questions since you are walking a very fine line here. I dont want you to rely on advice on this forum and then later find out that you were out of status and that triggers another set of challenges to deal with later. So consult a lawyer and see if he/she feels that you can stay back in US pending H1 approval. Else I would advice moving out for 1 Yr and starting things on clean slate.

Yes I did, but did not get a dual card. It says on the card - "Not Valid For Reentry to US" - my guess its not dual.

Did you say 2007!? and you haven't rcvd EAD cards till now!. Did you check with USCIS?

Hi,

I am E-filing my EAD thru online. There is a dropDown where it asks for "Current Immigration Status"...

My Situation:

1. Entered into USA using H1B Visa
2. Changed the job and now working using EAD
3. In othyer words, my status would be AOS Pending...

Now question is there is no "AOS Pending" status in that dropdown. SO, I am confused about chosing the correct status...

The nearest ones that I am thinking are "parolee" or "UNKNOWN"

Has anyone faced the situation? Could you please help me?
This is an interesting question, gurus please help, I think I will be facing the same question in a couple of months. I have seen that many people have successfully received their EAD using the e-file. Hopefully they will answer this question

I was with Company A. and had visa stamped for company A till Dec 2006. I switched from Company A to B in Nov 2004. and travelled to India in July 2005. Since I had a valid visa from company A, I didn't got it stamped with company B. Although I carried my transferred H-1 (Company B) and showed it to Immigration Officer upon arrival, which he was fine with.

someone please explain me how complete agreement works. I am working for the client through the main vendor who has a noncompete agreement with my employer (This is signed by my employer, not me). Now I am planning to leave my employer but the client is interested keeping me in the project through another vendor. Can someone explain me if it is possible?

Since the Noncompete is between my employer and the vendor, how am I responsible since I didn't sign anything? Don't laugh, may be I am ignorant

I have read many threads that discusses the pros and cons of using EAD over H1 and the common benefit that everyone mentions is that the salary is usually better for a person on an EAD. I spoke to several people who've started using their EAD and realized that even though it opened up opportunities with companies that do not have a policy of sponsoring H1, it DID NOT give them a boost in the salary.

My question is how do people intend to leverage on having an EAD for a higher salary?

Yes , as you are the one negotiating the deal (rate) on W2 or PERM with future employer and removing the agency ( your original H1B sponsoring compnay) between you and client, you should able to get better rate/salary. Again all depends on location, your experience and technology you are in.

go to uscis.gov and sign up for e-filing. fill in the I-131 form for urself and wife et al. u will seriously save a ton of money that can be done in 15 minutes and follow uscis instructions only.

did that 3 months ago. got an RFE about photographs not being compliant with us passport requirements. sending response as I type.

I am scheduled to close my refinancing (changing from conventional to FHA). Quicken Loan processed my loan - of course their charges are a lot more than others. The point is, I did not face any objections so far due to EAD status. Of course they asked my EAD copy a few times. Hope this helps!

This lawsuit is about the 140000 visas been given out each year and in years 2008 and 2009.

There have been many people who received GCs in 2008 and 2009 in EB2 without regard to Priority number. Check Visa Bulletins from August 2008 and September 2008. People from 2006 were given GCs over 2004 and there was total chaos.

This lawsuit is to bring justice to the last three years of absolute anarchy.

This lawsuit is to bring in line how this 140000 number is distributed. How does processing of I-485s take place in USCIS.

I think Indian EB3 will join shortly.

Why are you stopping at 2007? Issues stared much before that.
Why do you forget the getting details of each and every VISA that was issued between 2003 and 2007 (days of backlog elimination center)? We hae a right to know that. I doubt EB based guys got benefit out of it....I do not think USCIS /DOS will ever reveal those numbers truthfully and even with 50% accuracy....
They just put almost every True Employment based applicant in backlog and gave GCs to 245i....I dont think that was justice. That was manipulation

You have an immaculate sense of timing! Had they processed your application a week late - you would have received only one year EAD card. No wonder you are called Saint :)!


His PD is July 2006. He would have gotten the 2 year EAD either way. EB2 India is June 01 2006.

I agree with the previous post that most of the House conservatives are right now trying to fight the bigger evil in their eyes - illegal immigration. Yesterday, on Cavuto on Business (Fox News), Tom Tancredo was waxing eloquent on the fact that he favors legal immigration, how he was the grandson of Italian immigrants blah blah blah. But remember, it was these very people who had forced the EB provisions out from S.1932. However, if Tancredo has to make any impact on American politics and be a serious player, he has to take these tactical positions favoring legal immigration when the talk everywhere is illegal immigration.

So what to take out of this? We should try and pin a lot of these "anti-immigrant" people down on their position on SKIL while they are trying to justify their position on illegal immigration, by saying they favor legal immigration. . I guess now is the time to act and get everyone to support SKIL, while they cannot appear to be inconsistent with their position on legal immigration.
